1. Scope of application
The use of these internet pages (hereinafter referred to as "the website") published by MVP Wines Sarl and/or its subsidiaries ("MVP") shall be permitted only under these conditions. In individual cases, these general Terms of Use may be augmented, amended or replaced by further provisions, e.g. for the purchase of products and/or services. The validity of the version of these general Terms of Use in force at the time shall be regarded as having been accepted by the user upon log-in, or, whenever separate log-in is not required, upon commencement of use.
Any user who views web offers addressed to companies or public corporations represents the respective company or public corporation, which will be liable for the user´s actions and knowledge.
2. Services
In its website, MVP shall make certain information available for accessing and/or down-loading. MVP accepts no responsibility for the up-to-dateness, correctness, completeness, or quality of the information provided.
Liability claims against MVP which refer to material or idealistic damage caused by the use or non-use of the information offered or the use of inaccurate and incomplete information shall always be excluded, provided that MVP cannot be proven to have acted intentionally or with criminal negligence.
All offers on the website are without obligation and are not binding. MVP retains the right to alter, expand or partially or entirely delete the MVP website without notice and to suspend publication temporarily or completely. Due to the nature of the internet and computer systems in general, MVP accepts no liability for the uninterrupted availability of its website.
3. Intellectual property
The data, information, and brand names in this website and other content or results generated or displayed using the presentation tools may be partially or totally downloaded, copied and memorized only for private, non-commercial use. Such use is limited to the acquisition of information regarding the goods and services offered.
Website data, contents or results shall not be collected, used, sold, leased, exploited, reproduced, expanded, altered or circulated for other than private purposes without prior written approval from MVP.
The copyright for published objects produced directly by MVP itself (graphics, audio documents, video sequences, texts, etc.) is the exclusive property of MVP. The processing or alteration, reproduction, or use of such objects in other electronic or printed publications is absolutely prohibited without MVP prior written approval. Copyright instructions and brand designations may not be altered or omitted.
All brands and trademarks mentioned in this website and any protected against third party claims are subject without restriction to the trademark protection laws valid case by case and the property rights of the respective registered owners. Mere mention does not imply that such trademarks are not protected against claims by third-parties.
Over and above the usage rights or other rights expressly granted, the user shall be granted no further rights of any kind, in particular to the company names and commercial property rights, such as patents, utility patterns or brands, nor shall MVP be subject to any corresponding obligation to grant such rights.

4. Password registration
Some pages of the MVP website may be password-protected. In the interests of the security of business transactions, access to these pages is only available to registered users. Users enjoy no automatic right of registration by MVP. In particular, MVP reserves the right to make web pages, including those previously freely accessible, subject to an obligation to register. MVP shall be entitled at any time to revoke access authorization by barring the access data without being required to state its reasons for taking such action, particularly if the user

- has breached these provisions or his duty of care in dealing with the access data,

- has not made use of the MVP website for an extended period.
Whenever registration is required, the user shall be obliged to provide truthful registration details and immediately notify MVP of any subsequent change to these details (where possible, online).
The user shall ensure that he receives the e-mails sent to the e-mail address he has specified.
After registration has been completed, the user is issued a user ID and password (hereinafter referred to as "user data").
The user shall ensure that the user data is not made available to third parties, and shall be liable for all orders and activities carried out under this user data. After each session of use, the user shall leave the password-protected area. Users who become aware that third parties are misusing such user data are required to inform MVP of the fact in writing and without delay. Notice can be given in advance by means of a simple e-mail, if applicable.
After receiving such notice, MVP shall block access to the password-protected area with this user data. Access shall be restored only after MVP has received a written request to this effect from the user or after re-registration.
The user can at any time submit a written request for the cancellation of his registration, provided that such cancellation does not preclude the correct execution of current contractual relationships. In this case, MVP shall delete all user data and all other stored data of personal nature regarding the user as soon as such data is no longer required.
5. References and links
The MVP website may contain hyperlinks to web pages belonging to third parties. MVP neither accepts any responsibility for the contents of these web pages nor acknowledges such web pages and their contents as its own because it has no control over the linked information and bears no responsibility for the content and information contained therein. Users use these web pages at their own risk.
6. Duties of the user
In utilizing the MVP website, the user shall not:
• - harm any persons or infringe their personal rights;
- offend public morality with his conduct;
- breach industrial property rights and copyright, or other rights of ownership;
- transmit contents containing viruses, Trojan horses, or other programmed elements capable of damaging software;
- enter, store or send hyperlinks or contents for which he has no authorization, in particular, when these hyperlinks or contents breach confidentiality obligations or are contrary to the law;
- distribute advertising material or unsolicited e-mails (so-called "spam") or unfounded warnings against viruses, malfunctions and the like, or solicit or request participation in gaming, snowball systems, chain letters or pyramid schemes, or solicit similar campaigns.
MVP shall be entitled at any time to bar access to its website, particularly if the user breaches his obligations in relation to these provisions.
7. Exclusion of liability
Given that the information is provided free of charge, MVP declines all liability in regard to warranty of title and quality of information, in particular in relation to its accuracy, correctness, freedom from third-party industrial property rights and copyright, completeness and/or practicability except in case of intent or malice.
The information in the website may contain specific or general descriptions of the technical performance of products, which in some cases (e.g. as a result of product modification) may not always be available. The desired product performance features must therefore be agreed upon case by case prior to purchase.
Although MVP always endeavours to keep its website free of viruses, MVP issues no guarantee as to its freedom from such viruses. Before downloading information, the user shall ensure, for his own protection and to prevent virus infection in the MVP website, that appropriate security mechanisms and virus scanners are in place.
